Volgens de wet bouwt een werknemer die langer dan zes maanden ziek is geen vakantiedagen meer op. Dat gaat veranderen.

Het Europese Hof van Justitie bepaalde vorig jaar dat het stopzetten de opbouw van vakantiedagen tijdens ziekte in strijd is met de Europese grondrechten en de Arbeidstijdenrichtlijn.
Nederlandse werknemers en werkgevers kunnen zich niet rechtstreeks op deze uitspraak beroepen. Eerst moet de Nederlandse wet aangepast worden.

Dat gaat nu hoogstwaarschijnlijk gebeuren. Er ligt al een wetsvoorstel in Den Haag om de strijdigheid met het Europese Hof op te heffen. Dit betekent dat zieke werknemers in de toekomst minstens twintig vakantiedagen opbouwen per jaar.
In het wetsvoorstel staat ook dat de werkgever ervoor moet zorgen dat werknemers vakantiedagen binnen anderhalf jaar opnemen. Als werkgever ben je er dus straks verantwoordelijk voor dat je werknemers rust nemen.
